1. About These Terms

These Terms of Service ("Terms") govern your use of the Tenkobo mobile application and web platform ("Service") operated by Kronerland AS, a Norwegian company with registered address at Olsvikmarken 82, 5183 Olsvik, Bergen, Norway (Organization Number: 935 974 224).

These Terms constitute a legally binding agreement between you and Kronerland AS. By accessing or using Tenkobo, you agree to be bound by these Terms.

2. Eligibility and Account Creation

Age Requirements

• Minimum age with parental consent: 16 years old
• Minimum age without parental consent: 18 years old
• Users under 16: Not permitted to create accounts or use Tenkobo services
• Age verification: Users must provide accurate age information during registration
• False information: Providing incorrect age information violates these Terms and may result in account termination

Parental Consent Process

Users aged 16-17 require verified parental or guardian consent before creating an account. This process includes:

• Parental verification through secure methods
• Clear explanation of services and data collection to parents
• Ongoing parental oversight rights
• Ability for parents to withdraw consent at any time

Account Security

• You are responsible for maintaining the security of your account credentials
• You must provide accurate and complete information when creating your account
• You must notify us immediately of any unauthorized use of your account
• One person may only maintain one account unless specifically authorized by us

3. Service Description

Tenkobo provides educational tools and services including:

Core Features

• Surpass: Flashcard-based learning system with spaced repetition for UTME preparation
• SurpassGames: Competitive learning platform with leaderboards and monetary rewards
• FirstClassAI: CGPA calculation and academic planning tools
• PriceTracker: Price comparison and tracking for essential goods and services

4. Subscription and Payment Terms

Free and Premium Services

Tenkobo offers both free and premium features. Premium subscriptions unlock advanced functionality and unlimited access to certain features.

Payment Processing

• Android App: Payments processed through Google Play Store billing
• iOS App (Future): Payments processed through Apple App Store billing
• Web App: Payments processed through Stripe, with future support for PayStack and/or Flutterwave

Billing and Refunds

• Subscriptions automatically renew unless cancelled
• Prices are subject to change with 30 days' notice
• Refunds are handled according to the platform's policy (Google Play, Apple App Store). Subscriptions purchased through the web app are not eligible for refunds
• You can cancel your subscription at any time through your account settings

SurpassGames Rewards

Monetary rewards in SurpassGames are subject to:

• Verification of identity and eligibility
• Compliance with game rules and fair play policies
• Minimum payout thresholds and processing times
• Tax obligations according to your local jurisdiction

5. Acceptable Use Policy

Permitted Use

You may use Tenkobo for personal, educational purposes in accordance with these Terms.

Prohibited Activities

You may not:

• Share your account credentials with others
• Use automated tools or bots to interact with the service
• Attempt to reverse engineer or extract our educational content
• Engage in cheating or manipulation in SurpassGames
• Create multiple accounts to gain unfair advantages
• Use the service for any illegal or unauthorized purpose
• Interfere with or disrupt the service's operation
• Upload harmful code, viruses, or malicious content

6. Intellectual Property Rights

Our Rights

Tenkobo and all related content, features, and functionality are owned by Kronerland AS and protected by copyright, trademark, and other intellectual property laws.

Your Rights

We grant you a limited, non-exclusive, non-transferable license to use Tenkobo for your personal educational purposes.

User-Generated Content

Any content you create or upload to Tenkobo remains yours, but you grant us a license to use it to provide and improve our services.

7. Service Availability and Modifications

• We strive to maintain high service availability but do not guarantee uninterrupted access
• We may modify, suspend, or discontinue features with reasonable notice
• Scheduled maintenance will be communicated in advance when possible
• We reserve the right to impose usage limits to ensure fair access for all users

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers and Limitation of Liability

Service Disclaimers

• Tenkobo is provided "as is" without warranties of any kind
• We do not guarantee the accuracy of educational content or price information
• We do not guarantee specific exam results or academic outcomes
• Third-party content and services are beyond our control

Limitation of Liability

To the maximum extent permitted by law, Kronerland AS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Tenkobo. Our total liability shall not exceed the amount you paid for premium services in the 12 months preceding the claim.

10. Termination

Your Right to Terminate

You may terminate your account at any time by contacting us or using the account deletion feature.

Our Right to Terminate

We may suspend or terminate your access if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent or harmful activities
• Fail to pay applicable fees
• Request account deletion

Effect of Termination

Upon termination, your right to use Tenkobo ceases immediately. We may retain certain data as required by law or legitimate business purposes as outlined in our Privacy Policy.

11. Governing Law and Dispute Resolution

Governing Law

These Terms are governed by Norwegian law, regardless of your location. This choice of law does not affect your statutory rights as a consumer in your country of residence.

Dispute Resolution

Before initiating formal legal proceedings, we encourage you to contact us directly to resolve any disputes. Most issues can be resolved through good-faith discussion.

For Nigerian users: You retain the right to seek resolution through Nigerian courts and regulatory authorities, including NITDA, as applicable under Nigerian law.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will provide notice of material changes through the app, email, or our website.

Continued use of Tenkobo after such changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you should discontinue using the service.

13. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kronerland AS regarding the use of Tenkobo.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time.
